In Georgy Soman vs. Mohinder Singh & Ors. ( MAC.APP. 429/2006) the Hon'ble Delhi High Court has held that as a general rule a person has to be compensated in case of injury caused due to motor accident, not only for the physical injuries but also for the loss which he has suffered as a result of such injury. Compensation to victims is fixed on the basis of a formula that takes into account the age of the victim, his income status and position and the Court has also to take into consideration the pecuniary and non-pecuniary damages as well. The main parameter in case of calculating compensation in such cases is loss of future earnings of the victim.
In our opinion, such balanced judgment of the Court shows that the court has started taking a more sympathetic view of the claims made by the victims of the motor accidents.
