Various laws that govern the Real Estate sector:

We have the Transfer of Property Act, which deals with both movable and immovable property, and the Indian Easements Act, both effective from 1882; the Registration Act, again which is old from 1908; the Slum Areas (Improvement and Clearance) Act which was passed in 1956, and the not so old Environment (Protection) Act 1986 and the Forest (Conservation) Act of 1980; and then the very recent Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act of 2013, and Real Estate (Regulation and Development) Act 2016 and the Benami Transactions (Prohibition) Amendment Act, which came into effect on 1st November 2016; and the Indian Stamp Act 1899 which is also old but has been amended several times by various States; and the Special Economic Zones Act of 2005. And of course there are other municipal and local laws.

Real Estate (Regulation and Development Act), 2016:

The Real Estate (Regulation and Development) Act (RERA), 2016 was enacted to protect the interest of homebuyers and safeguard them against the unfair practices of real estate and housing project developers. Under RERA, it has become compulsory for developers to obtain all requisite approvals from different government agencies before they can reveal the project to the public. The developers have to display all the information relating to the project on appropriate website of State RERA Authority established under RERA.

The primary benefit of RERA is the simplification of procedure to file a complaint in RERA Authority. Previously, homebuyers could file a complaint with the Consumer Disputes Redressal Commissions (CDRC), which took ample amount of time in disposing of complaint for possession delay. The RERA regime makes it faster to file a complaint and take action against the builder for possession delay. Moreover, the real estate sector of India is largely unregulated. If a consumer had a complaint against a developer they would have to make rounds of consumer or civil courts. Now, in the case of any grievance, the consumer can go to the real estate regulator for redressal.

Hierarchy of Tribunals and Courts under RERA:

Property lawyers represent both, corporate commercial and private property owners, in handling commercial and domestic purchases and sales, mortgages, gifts and leasehold transactions. They assist with drafting of lease deeds, sale or purchase deeds, mortgage deeds, title deeds and gift deeds.
